NOTE: Publication is NOT required if a petitioner wishes to change their name to reflect a change in gender identity. Once you have the court order for a new legal name and/or gender marker, it`s time to change additional documents. You can use the documents given to you by the court to go directly to the Social Security Office after your hearing date if you wish to do so on the day. You can also plan ahead and make an appointment for the DMV later in the day for your drivers to change on the same day! You must bring the court order and personal identification such as a driver`s license or passport. Once you`re at the Social Security office, grab a number, fill out the form for a new Social Security card, and sit down. Please note that on the form, you will indicate the name and gender that you have legally changed in your court order. Your Social Security card won`t show your gender on the card, but it`s listed in their system, so it`s important that you include your legal gender on the form when you submit it so that the person changes it in their system. When your number is called, hand over your documents, show them your legal gender on the form, and check if they changed it before you leave. They will send you your new card. Dress with the physical appearance and presentation of the sex that suits you best. Arrive early to have enough time to find a parking space and get to the courtroom.
Bring a stamped copy of all documents to the courthouse. Find your assigned courtroom and wait outside. There will be a list (called a Court Transcript) outside the courtroom on the wall showing the name and number assigned to each. Search for your name and number. You only call your last name and number when it`s your turn. Once they call your name, you sit in the courtroom and the judge checks your documents. If everything is correct, the judge will explain your new legal name! However, after a divorce, you are not limited to reverting to your old legal name. You can use any of the San Diego County courts to change your name to any name, as long as you live in San Diego, if you want to make that name change. This is true even if your divorce wasn`t in San Diego or even another state. As long as you now live in San Diego, you can use the San Diego Superior Court to legally change your name through a name change case. If you include a new name in your San Diego County application that is not allowed by the Equal Names Act of 2007, even if the employee accepts it, your new name may not fly with other government agencies such as Social Security, DMV, etc. You cannot change the information on the marriage certificate once it has been issued by the county clerk.
The court has the discretion to grant your name change application without a formal hearing, as long as your application form does not raise red flags and no objections have been raised by the public. Confirm the scheduled hearing with the court clerk the day before the hearing date to determine if the application was allowed without a hearing. If the court has rendered the judgment, retrieve your documents from the clerk. The California Department of Health (CDPH) creates and maintains birth certificates for anyone born in California.
